EPA Proposes Rules that would Significantly Lower Emissions

The United States Environmental Protection Agency (EPA) has proposed rules that would significantly lower automotive emissions. Click here to read the EPA’s official press release on the proposal.

Key provisions include:

  • Fleet average of no more than 82 grams of carbon/mile (light duty cars and trucks and medium duty vehicles)
  • Fleet average of no more than 12 milligrams of nitrogen oxides/mile
  • Applicable to vehicles sold in model years 2027 through 2032

Republican members of Congress criticized the proposal. Congresswoman Kathy McMorris-Rodgers – chair of the House Energy and Commerce Committee – stated in a press release that, “The Environmental Protection Agency will make cars unaffordable…with these proposals, people will be forced to pay more for a car they can’t afford…This will hurt low-income families the most, while also making us more reliant on China for critical minerals necessary for electric vehicles.” Click here to read Chairwoman McMorris-Rodgers’ full statement.

Democrats expressed greater support for the proposal. Senator Tom Carper – Chairman of the Senate Environment and Public Works Committee – stated, “Thanks to recent technological advancements and historical levels of investment through the Inflation Reduction Act and Bipartisan Infrastructure Law, electric vehicles are more affordable and in demand than ever before. In addition to providing regulatory support to where the market is already heading, EPA’s proposed vehicle emissions standards…will save Americans money at the pump and better insulate our country from the volatility of the global oil market. EU Advances Legislation on Vehicle Data Access

The European Union Parliament held the first of three votes needed to pass legislation that would amend its Data Act to account for vehicle data access. The legislation passed that first round vote. If it were to pass the next two rounds, it would change EU law to allow drivers to access the data their vehicle generates. It would also allow OEMs and companies to not make certain data available by design.

The European Association of Automotive Suppliers (CLEPA) opposes the proposal. Instead, it wants European Commissioner Thierry Breton to “urgently bring forward long-planned legislation on access to in-vehicle data, functions, and resources,” that his commission has been working on, by fall of 2023, as communicated in its statement.

Earlier this year, CLEPA published a position paper – in conjunction with industry allies – calling on the European Commission to provide regulatory guidance on in-vehicle data access.

TX State Senate Committee Approves SB 1083

The Texas State Senate’s Business & Commerce Committee unanimously passed Senate Bill (SB) 1083 on Tuesday. SB 1083 would mandate insurance companies to:

  • Require the use of the part, product, or repair process used by the OEM or distributor to repair the vehicle for cars owned for LESS than 36 months and new at the time of purchase (policy owner or third-party claimant can opt-out with written consent)
  • Not limit the policy holder or third-party claimant from selecting the repair person or facility of their choice for cars owned for LESS than 36 months and new at the time of purchase
  • Not limit the policy coverage based on brand, type, age, vendor, supplier, or condition of parts or products or the repair process for cars owned for MORE than 36 months
  • Not require or request a repair person or facility to use a certain percentage of non-original equipment to repair a vehicle

NHTSA Reports Car Crash Fatalities in 2021 Highest since 2005

The National Highway Traffic Safety Administration (NHTSA) released a report detailing crashes involving motorists in 2021. The increase in crashes from 2020 to 2021 outpaced the increase in vehicles on the road for the same time period. In 2021, 42,939 people were killed in motor vehicle traffic crashes, a 10% increase from the 39,007 fatalities in 2020 and the highest total since 2005. Injuries on the roadways increased 9.4%. Meanwhile, total miles traveled only increased by 8.1%. The fatality rate per 100 million vehicle miles traveled increased by 2.2%.

The report also investigated trends pertaining to three behavior factors: speeding, alcohol-impaired driving, and seat belt non-use. While the data compiled on these factors is extensive, it notes that 55% of drivers involved in a fatal accident in 2021 were not impacted by those factors. That 55% includes faulty brakes, headlights, tires, or other vehicular defects that are identified in safety inspections, but are not considered in the report.

The National Roadway Safety Strategy released by the Department of Transportation in January 2022 notes, “To ensure the safe operations of commercial trucks and motor carriers, the Department continues to identify high risk companies and operators of commercial motor-vehicles using a data-driven and performance-based approach, including roadside commercial vehicle safety inspections.” The Federal Government must consider more seriously vehicle condition and repair as part of its goal to understand and address the roadway safety problem.

EPA Approves California’s Advanced Clean Truck Rule

Post content here.The EPA approved California’s Advanced Clean Truck rule intended to leave very few gas-powered heavy-duty vehicles on the roads in the state by 2035. Truck manufacturers will be required to sell an increasingly greater share of zero-emission trucks relatively to gas-powered vehicles. California joins Massachusetts, Vermont, New Jersey, New York, Washington, and Oregon in adopting this rule, which will now cover a quarter of the country’s automotive market.

28 State and U.S. Territory AGs Urge Congress to Pass Right-to-Repair Law

A bipartisan group of State and U.S. Territory Attorneys General signed a letter urging Congress to pass “Right-to-Repair” legislation. Addressed to the chair and ranking member of the U.S. Senate Committee on Commerce, Science, and Transportation and the U.S. House Energy and Commerce Committee, the letter specifies that the law should cover automobiles, agricultural equipment, and digital electronic equipment. The authors of the letter noted that three bills – The Fair Repair Act, The SMART Act, and the REPAIR Act – were all introduced during the last Congressional session, but none of them received a vote.

Massachusetts AG Tells Court State Will Start Enforcing New Right-to-Repair Law on June 1

March 9, 2023 – Washington, DC – On Tuesday, earlier this week, Massachusetts Attorney General Andrea Campbell notified the U.S. District Court of Massachusetts that her office will begin enforcing the Data Access Law on June 1, 2023.

Approved by voters through a ballot measure in 2020, the law requires automobile manufacturers with sales operations in the state to provide vehicle owners and independent repair shops real-time access to telematics information. The OEMs would deliver that data through a standardized, open-access platform for all 2022 model year vehicles or newer. The Alliance for Automotive Innovation sued Massachusetts to block the law, arguing that it conflicts with federal law, poses cybersecurity and vehicle safety risks, and doesn’t provide its members enough time to adjust to comply.

The case went to trial and the court heard arguments from both sides in the summer of 2021. The court asked the state to enter a non-enforcement stipulation until after the verdict is reached. Then-Attorney General and current Massachusetts Governor Maura Healey agreed to not enforce the rule until August 1, 2021. The Attorney General has since extended the non-enforcement stipulation several times at the court’s request.

In the March 7, 2023, filing, newly elected AG Campbell noted the following:

“In addressing the Court’s prior requests for stipulations of non-enforcement, the Attorney General has sought to balance competing concerns. On the one hand, recognizing the demands of a busy trial court, the technical complexity of the trial evidence, and the disruptions of the COVID-19 pandemic during the litigation of this case, the Attorney General has deferred to the Court’s view that it needs more time and further evidence to produce an opinion that brings ‘this case to an appealable final judgement’…On the other hand, the Attorney General has a specific statutory duty to issue the notice provided for under Section 4 of the Data Access Law…After consideration of these competing concerns, the Attorney General has determined that the non-enforcement stipulation should come to an end.”

EPA Finalizes Rule on Heavy-Duty Vehicle Emission Standards

The Environmental Protection Agency (EPA) released a final rule on the "Control of Air Pollution from New Motor Vehicles: Heavy-Duty Engine and Vehicle Standards" today. This final rule seeks to  further reduce air pollution, including ozone and particulate matter (PM), from heavy-duty engines and vehicles across the United States.

The final program includes new emission standards that are significantly more stringent and that cover a wider range of heavy-duty engine operating conditions compared to today’s standards; further, the final program requires these more stringent emissions standards to be met for a longer period of when these engines operate on the road.

AFBF Signs Right to Repair Memorandum of Understanding With John Deere

The American Farm Bureau Federation (AFBF) has signed a Memorandum of Understanding (MOU) with John Deere that ensures farmers' and ranchers' ability to repair their own equipment. The MOU requires John Deere to provide farmers and independent repair facilities access to the tools, information, and software required to make repairs to John Deere equipment.

“[The memorandum] ensures that our farmers can repair their equipment and have access to the diagnostic tools and product guides so that they can find the problems and find solutions for them,” said American Farm Bureau Federation president Zippy Duvall. “And this is the beginning of a process that we think is going to be real healthy for our farmers and for the company because what it does is it sets up an opportunity for our farmers to really work with John Deere on a personal basis.”

Additionally, the American Farm Bureau Federation has made a commitment to John Deere that encourages its state organizations to enact statewide right-to-repair legislation for agricultural equipment.

U.S. EPA Releases Rule on Air Emissions for Heavy-Duty Trucks

The U.S. Environmental Protection Agency (EPA) released a rule today that will require heavy-duty trucks sold in 2027 to significantly decrease their air emissions of nitrogen oxides and other pollutants. This rule is a result of the Biden administration's initiative to eliminate carbon emissions from the transportation sector.

Although these emissions restrictions are significant, the rule falls short of the emissions restrictions in the state of California, which many environmental groups were hoping to be adopted as a federal standard. The EPA estimates that these restrictions will cut NOx emissions from heavy-duty vehicles 47 percent by 2024.

EPA said that the rule will bring $29 billion in annual net benefits, preventing as many as 2,900 premature deaths and 18,000 cases of childhood asthma, resulting in 6,700 fewer hospital emissions and emergency room visits.

It will cost between $3.9 billion and $4.7 billion annually, according to EPA estimates.
