Electric Vehicle Charging Station Legislation Introduced in the U.S. House of Representatives

Congressman Levin (D-Mich) introduced a bill, the Electric Vehicles Freedom Act, that would establish a nationwide network of public electric vehicle charging stations. This legislation is part of a larger push toward electrifying the transportation sector as part of President Biden’s American Jobs Plan, which was released earlier this year.

Establishing a nationwide network of electric vehicle charging stations would mitigate the effects of “range anxiety” which dissuades consumers from purchasing electric vehicles due to concerns that the vehicles would not be able to travel long distances without convenient charging stations. Electric vehicle charging stations will be essential infrastructure to reach the ambitious goals set for electrification of the transportation sector.

SBA Announces Streamlined Loan Forgiveness Process for Small PPP Loans

The Small Business Administration (SBA) announced a streamlined process for Paycheck Protection Program (PPP) Loans under $50,000. Loans under $50,000 account for approximately 3.5 million of the 5.2 million total loans issued through PPP.

This announcement comes after consistent complaints from small business owners about difficulties they have faced throughout the loan forgiveness process, which opened in early August. The new streamlined forgiveness process is intended to allow SBA to expedite the loan forgiveness payments, as well as ease the burden on small businesses and lender organizations.

NHTSA Reports Increase in Traffic Fatality Rate

U.S. House Small Business Committee Holds Hearing on Fraud and the PPP

The United States House of Representatives Committee on Small Business conducted a hearing today to discuss ongoing fraud in the Paycheck Protection Program (PPP) and potential remedies. This hearing follows a Government Accountability Office (GAO) report that the Small Business Administration (SBA) neglected critical oversight procedures for the PPP, which left the program susceptible to fraud.

Witness William Shear, Director of Financial Markets and Community Investment at the GAO, stated that the SBA has been obstructing attempts by the GAO to acquire loan-level data and assist in fraud prevention. He suggested that going forward, the SBA should work hand-in-hand with the GAO to implement internal safeguards to prevent fraudsters from infiltrating the impending loan-forgiveness process.

Thus far, the Department of Justice has issued charges in over 50 cases of PPP fraud. In addition, there have been reports of duplicate loan applications, applications under fraudulent names, identity theft, and phishing scams related to the Paycheck Protection Program.

California Governor Calls for Ban on Gas-Fueled Cars by 2035

 

California Governor Gavin Newsom released an executive order yesterday requiring that by 2035, all new cars and passenger trucks sold in California will be zero-emission vehicles. In his press release, Newsom cited increased concern about the effects of pollution and climate change caused by gas-fueled vehicles.

Although the order prohibits the sale of new gas-fueled vehicles by 2035, it does not prevent Californians from owning gasoline-powered cars or selling them on the used car market.

U.S. Senate Committee on Commerce, Science and Transportation Revisit the Need for Federal Data Privacy Legislation

The U.S. Senate Committee on Commerce, Science and Transportation convened today in a hearing to discuss the renewed need for federal data privacy legislation. The discussion focused heavily on California’s Consumer Privacy Act (CCPA) of 2018, which has been widely viewed as the most progressive data privacy legislation in the United States. However, due to the largely interstate nature of data use, the CCPA has been difficult to enforce and signals the urgent need for cohesive federal data privacy legislation.

The hearing was led by U.S. Senator Roger Wicker (R-MS), who recently introduced the SAFE DATA Act in coalition with other Senate republicans. Witnesses included four former chairmen of the Federal Trade Commission as well as the Attorney General for California, Xavier Becerra.

It is unlikely privacy legislation will move forward in the 116th Congress.

House Republican E/C Committee Members Introduce AV Legislation Bill Fails to Address Vehicle Data Access

U.S. House Energy and Commerce Committee Republican Members introduced, today, Autonomous Vehicle legislation which addresses numerous Automaker concerns relative to research and deployment of autonomous vehicles. The legislation is similar to legislation previously considered by the Committee. Unfortunately, the bill does not address vehicle data access which is critical for independent automotive repairers. The 116th Congress is not expected to address this legislation or any AV legislation prior to adjournment for the year.

Government Accountability Office Predicts Trouble with PPP Loan Forgiveness

The Government Accountability Office (GAO) released a new report Monday warning of potential delays and bureaucratic difficulties for businesses attempting to convert their Paycheck Protection Program (PPP) loans into forgivable grants.

As of September 8, the Small Business Association (SBA) has processed and forgiven only 56,000 of the more than 5.2 million loans distributed through the PPP. The U.S. House Small Business Committee will meet this week to discuss concerns about the Paycheck Protection Program and hopefully formulate a plan to streamline loan forgiveness applications.

GAVDA Opposes Vehicle Data Restrictions

In an open letter, ASA and members of GAVDA stated their disagreement with the OEM’s recent letter to limit the access to vehicle data. In a letter to the U.S. House Energy and Commerce Committee, the Alliance for Automotive Innovation had sought for Congress to intervene in state efforts to address vehicle data access.

ASA has encouraged an auto industry agreement on vehicle data access or a federal government solution. If Congress intervenes, it should include provisions that assure independent repairers have access to the vehicle data necessary to repair their customers’ vehicles.

NSC releases preliminary semiannual estimates for road safety

WASHINGTON, D.C. – The National Safety Council (NSC) released their preliminary semiannual estimates for road safety today, and the results show a slight 1 percent increase in total motor-vehicle deaths in 2020 compared to 2019.

However, total number of vehicle miles travelled have decreased by nearly 17 percent since 2019, which means the death rate per mile travelled has increased significantly.

Overall, these preliminary estimates suggest that total motor vehicle deaths are on the rise, even people are driving less. In the report, the NSC stated that “the riskier roads threaten to reverse traffic safety gains made over the last few years.”

Already in 2020, there have been approximately 18,300 deaths, and $206.4 billion in motor-vehicle deaths, injuries, and property damage costs.
