Virginia Legislature Advances Bill that would Increase Insurers’ Obligation to Act in Good Faith

The Virginia House of Delegates' Courts of Justice Committee: Civil Subcommittee advanced SB 256 with 8 votes in favor and none opposed. It passed the full state senate on a 25-15 vote.

If enacted into law, SB 256 would obligate auto insurance companies to make claims decisions in good faith. Insurers would have to pay double a court's judgement - plus interest, attorney fees, and other related expenses - if the court finds that an insurer - acting in bad faith - "rejects a reasonable settlement demand made by the insured within the policy's coverage limits for uninsured or underinsured motorist benefits or fails to respond within a reasonable time after being presented with such demand after the insured has become legally entitled to recover."

Currently in Virginia, insurance companies are not required to make decisions in good faith under these circumstances, as determined by a 2017 court case.

AV Bill in Washington State Scheduled for Jan. 30 Hearing

A bill introduced in the state of Washington's legislature would create a new comprehensive regulatory framework that allows autonomous vehicles (AV) to operate on roads in the state without a human driver. Currently, AVs may only operate in the state under limited testing purposes.

The bill - known as Senate Bill (SB) 5594 - will receive a public hearing in the Senate Committee on Transportation at 4:00 PM Pacific Time on January 30, 2024. This committee heard testimony on the same bill during the last legislative session in winter 2023, but the committee did not advance it to the next step towards passage. Therefore, the bill must now restart the process from the beginning.

UPDATE: EPA Sends Tailpipe Emissions Proposal to White House for Final Review

The U.S. Environmental Protection Agency (EPA) has sent its high profile tailpipe rules proposal to the White House's Office of Management and Budget (OMB) for final review. The proposal's intended impact is for 67 percent of light-vehicles sold in the United States by 2032 to electric vehicles (EVs). OMB is responsible for overseeing and implementing the President's vision across the executive branch.

UPDATED JAN. 23, 2024:

Sixteen Republican governors signed a joint letter urging President Biden to put an end to efforts to move forward with its tailpipe rules proposal. The governors describe the proposal as "unrealistic", "costly", and a "prescriptive" solution that harms American consumers.

The governors of Arkansas, Idaho, Iowa, Louisiana, Missouri, Montana, Nebraska, Nevada, New Hampshire, North Dakota, Oklahoma, South Dakota, Texas, Utah, Virginia, and Wyoming signed the letter.

Biden Admin Awards $623 Million in Grants to Expand EV Charging Infrastructure

The Biden Administration has announced that it has awarded grants worth a combined $623 million to help expand EV charging infrastructure in the United States.

Administered by the Federal Highway Administration (FHWA), the grants are funded by the 2021 Infrastructure Investment and Jobs Act (IIJA), which allocated $2.5 billion towards a Charging and Fueling Infrastructure (CFI) Discretionary Grant Program. Projects aimed at addressing EV charging needs in urban and rural communities received $311 million. Projects aimed at narrowing EV charging service gaps along key roadway corridors received $312 million.

The 47 CFI grants were awarded to recipients in 22 states and Puerto Rico. Examples of projects include:

  • $4.9 million to improve EV charging access in Boulder, Colorado
  • $70 million to build EV charging and hydrogen refueling stations for freight trucks in Dallas, Houston, San Antonio, and Austin, which will also contribute to a California to Texas hydrogen fueling corridor

NHTSA Begins Effort to Require Impaired Driving Prevention Tech in New Cars

The United States Department of Transportation's National Highway Traffic Safety Administration (NHTSA) has formally launched an effort to require that drunk or impaired driving prevention technologies come standard in new vehicles.

In its advanced notice of proposed rulemaking, the agency requests the public's input on the information needed to develop a  rulemaking proposal "that require that new passenger motor vehicles be equipped with advanced drunk and impaired driving prevention technology through a new Federal Motor Vehicle Safety Standard." Comments should be submitted no later than March 5, 2024.

U.S. Senators Raise Alarm on Alleged Tesla Safety Flaws

United States Senators Ed Markey (D-MA) and Richard Blumenthal (D-CT) have sent a letter to Elon Musk following a report from Reuters on Tesla vehicles' safety flaws.

In their letter, the Senators note that, "[t]he report details complaints about suspension connection points, including fore and aft links, and sudden losses of power steering - often while a vehicle was in motion." The Reuters report alleges that Tesla privately was aware of these flaws, but publicly cast blame on drivers, including during its engagement with the National Highway Traffic Safety Administration (NHTSA).

Tesla has refutes the report's findings. The company stated on Twitter, "The author has conflated a noise-related (non-safety) issue with a range of unrelated and disconnected service actions. Contrary to the article’s statements based on erroneous data, Tesla is truthful and transparent with our safety regulators around the globe and any insinuation otherwise is plain wrong."

Markey and Blumenthal request that Musk provide corrections for the record and commit to providing NHTSA with accurate information moving forward.

LiDAR Imports and Exports to and from China Scrutinized by U.S. House Members

A bipartisan group of twenty members of the U.S. House of Representatives sent a letter to the Secretaries of the Departments of Defense, Commerce, and the Treasury raising concern with light detection and ranging (LiDAR) technology imports and exports to and from China.

The letter - led by House Select Committee on Strategic Competition between the United States and the Chinese Communist Party (CCP) Chairman Mike Gallagher (R-WI) and Ranking Member Raja Krishnamoorthi (D-IL) - explains that LiDAR is used in autonomous vehicle systems. Specifically:

"It uses pulsed laser light to measure the distance, speed, and/or altitude of physical objects to map the surrounding environment. The technology is crucial for creating high-definition maps around autonomous vehicles, raising serious national security concerns related to data security, cybersecurity, and exquisite mapping of U.S. infrastructure... There is a serious national security risk that under [China's] National Security Law, all [Chinese] LiDAR companies must provide any available data collected by their products and systems to the CCP, when required."

For these reasons, the lawmakers asked the department secretaries to investigate if import and export restrictions on LiDAR products to and from China are warranted. This letter reflects the growing intersection between automotive, data privacy, and national security policy.

NJ Approves Zero Emission Vehicles Regulation

New Jersey Governor Phil Murphy (D) announced last week that the state will move forward with adopting California's Advanced Clean Cars Rule II. Beginning in 2027, the regulation will require vehicle manufacturers to produce fleets comprised of a certain percentage of electric vehicles, with that percentage growing each year. All new vehicles a manufacturer produces will have to be EVs by 2035.

FTC Returns Additional $857K to Those Harmed by Junk Auto Fee Practices

The Federal Trade Commission (FTC) has announced it is disbursing more than $857,000 cumulatively in its second round of compensatory payments to customers harmed by Napleton Automotive Group's illegal junk fees and discriminatory practices.

Napleton Automotive Group, which is based in Illinois, is the thirteenth largest dealership group in the United States based on revenue in 2020. The FTC and State of Illinois sued Napleton in March 2022 for sneaking unwanted "ad-ons" onto vehicle purchases and discriminating against black customers by charging them more for ad-ons and financing. In the settlement, Napleton agreed to pay nearly $10 million in monetary relief to customers, the highest settled amount ever in an auto finance case.

The FTC is sending 37,034 checks in this second round of payments. After the first round of payments, 88% of recipients cashed checks with an aggregate worth of $8.8 million.
