ASA Launches “Repair Policy Scan Tool” Legislative Newsletter

Lawmakers rely on constituent feedback to make good decisions. Staying informed about the laws they are considering that could impact an auto repair shop owner or operator's ability to run a successful business empowers repairers to speak up in crucial moments. But it's hard to keep up with the news, especially when your hands are already full with the responsibilities and pressures of running a business. ASA is launching a tool to make it easier.

Every two weeks or so, ASA will send out a new edition of "Repair Policy Scan Tool." Of the thousands of bills introduced each year in Congress and state legislatures, this newsletter will help distill the legislative developments that matter most to auto repair professionals on just one easy to read page.

Rhode Island Bill would Limit Insurers’ Ability to Deny Coverage for OEM Repair Parts

A bill was introduced in the Rhode Island Legislature that would restrict insurance companies' ability to refuse to cover OEM repair parts in certain situations.

Under the current law in Rhode Island, insurers are not allowed to require the use of non-OEM parts on vehicles that are less than 48 months beyond their manufactured date, unless the repairer has received written consent from the vehicle owner to use those parts. The recently introduced legislation - titled H. 7264 - would forbid insurance companies from refusing the use of OEM parts when negotiating repairs with a repairer for vehicles that are between 48 to 72 months from their manufactured date, as long as the repairer has written consent from the vehicle owner to install OEM parts. The proposed change would not apply to the repair or replacement of motor vehicle glass.

ASA, OEMs, and SCRS Offer Themselves as a Resource to Congress and Constituents

The Automotive Service Association (ASA), the Alliance for Automotive Innovation (Alliance), and the Society of Collision Repair Specialists (SCRS) have sent a joint letter to Congress offering to assist constituents who are encountering difficulties locating vehicle diagnostic and repair data.

The letter acknowledges that the rapid pace of automotive innovation can lead to confusion with regards to accessing the data needed to repair a vehicle. The parties assure Congress that this information is available to vehicle owners and independent repair shops of their choosing, as stipulated in the agreement the three groups signed in July 2023. That agreement explicitly states that independent repairers are entitled to the same diagnostic and repair data that the OEMs provide to their franchised dealerships, and that new technologies - like telematics and alternative power transmissions - may interfere with that right. The letter invites Congressional offices to email repairinfo@autosinnovate.org should they "ever hear from a constituent experiencing a challenge with repairing a vehicle at a location of his or her choosing." The letter signatories are happy to direct the office and constituent to the appropriate resource.

U.S. Senators Raise Alarm on Alleged Tesla Safety Flaws

United States Senators Ed Markey (D-MA) and Richard Blumenthal (D-CT) have sent a letter to Elon Musk following a report from Reuters on Tesla vehicles' safety flaws.

In their letter, the Senators note that, "[t]he report details complaints about suspension connection points, including fore and aft links, and sudden losses of power steering - often while a vehicle was in motion." The Reuters report alleges that Tesla privately was aware of these flaws, but publicly cast blame on drivers, including during its engagement with the National Highway Traffic Safety Administration (NHTSA).

Tesla has refutes the report's findings. The company stated on Twitter, "The author has conflated a noise-related (non-safety) issue with a range of unrelated and disconnected service actions. Contrary to the article’s statements based on erroneous data, Tesla is truthful and transparent with our safety regulators around the globe and any insinuation otherwise is plain wrong."

Markey and Blumenthal request that Musk provide corrections for the record and commit to providing NHTSA with accurate information moving forward.

LiDAR Imports and Exports to and from China Scrutinized by U.S. House Members

A bipartisan group of twenty members of the U.S. House of Representatives sent a letter to the Secretaries of the Departments of Defense, Commerce, and the Treasury raising concern with light detection and ranging (LiDAR) technology imports and exports to and from China.

The letter - led by House Select Committee on Strategic Competition between the United States and the Chinese Communist Party (CCP) Chairman Mike Gallagher (R-WI) and Ranking Member Raja Krishnamoorthi (D-IL) - explains that LiDAR is used in autonomous vehicle systems. Specifically:

"It uses pulsed laser light to measure the distance, speed, and/or altitude of physical objects to map the surrounding environment. The technology is crucial for creating high-definition maps around autonomous vehicles, raising serious national security concerns related to data security, cybersecurity, and exquisite mapping of U.S. infrastructure... There is a serious national security risk that under [China's] National Security Law, all [Chinese] LiDAR companies must provide any available data collected by their products and systems to the CCP, when required."

For these reasons, the lawmakers asked the department secretaries to investigate if import and export restrictions on LiDAR products to and from China are warranted. This letter reflects the growing intersection between automotive, data privacy, and national security policy.

FTC Returns Additional $857K to Those Harmed by Junk Auto Fee Practices

The Federal Trade Commission (FTC) has announced it is disbursing more than $857,000 cumulatively in its second round of compensatory payments to customers harmed by Napleton Automotive Group's illegal junk fees and discriminatory practices.

Napleton Automotive Group, which is based in Illinois, is the thirteenth largest dealership group in the United States based on revenue in 2020. The FTC and State of Illinois sued Napleton in March 2022 for sneaking unwanted "ad-ons" onto vehicle purchases and discriminating against black customers by charging them more for ad-ons and financing. In the settlement, Napleton agreed to pay nearly $10 million in monetary relief to customers, the highest settled amount ever in an auto finance case.

The FTC is sending 37,034 checks in this second round of payments. After the first round of payments, 88% of recipients cashed checks with an aggregate worth of $8.8 million.

PLACE HOLDER: POST ON 11/14/23 JUDICIARY HEARING

Earlier this week, the U.S. House Judiciary Committee, Subcommittee on the Administrative State, Regulatory Reform, and Antitrust held an oversight hearing. Jonathan Kanter, the Assistant Attorney General who leads the U.S. Department of Justice's Antitrust Division, provided testimony.

Assistant Attorney General Kanter defended his office's investigations into monopolistic activities that go beyond just unfair prices for consumers. These activities include those that prevent Americans "from making free choices between market alternatives", as noted by Rep. Harriet Hageman (R-WY). Kanter argued that, "antitrust is not just about price. It is about quality, it is about innovation, and it is about choice, as well as many other things."

Many Democrats and Republicans found strong agreement that not having a defined consumer welfare standard has made it harder to investigate and enforce antitrust law, as Kanter noted "If you asked five antitrust lawyers, 'what is the consumer welfare standard?' you'll often get six different answers. A standard isn't a standard unless everyone agrees as to what it is."

EPA Excludes MVAC Fluid Recovery from Final Ruling on Hydrofluorocarbons

Yesterday, the EPA released its final rulemaking on the Phasedown of Hydrofluorocarbons (HFCs): Management of Certain Hydrofluorocarbons and Substitutes under Section (h) of the American Innovation and Manufacturing Act of 2020. Notably for automotive repairers, the regulation excludes any mention of the recovery/recycling/reclamation of MVAC (motor vehicle air conditioner) refrigerant fluids.

The preamble to the final ruling explicitly states:

“…even though the [American Innovation and Manufacturing] Act grants EPA broad authority to achieve a full transition from regulated substances in a sector or subsector, there are many actions not included within the scope of the restrictions covered by this final rule, including actions associated with steps in the disposal chain such as recovery, recycling, and reclamation of a regulated substance…” (Page 67).

However, regulatory proposals from recovering/recycling/reclaiming MVAC refrigerants could come in the future. The preamble acknowledges that:

“EPA is developing proposed regulations under the authority of subsection (h) of the AIM Act. Subsection (h)(1) of the Act, ‘[f]or purposes of maximizing reclaiming and minimizing the release of a regulated substance from equipment and ensuring the safety of technicians and customers, the Administrator shall promulgate regulations to control, where appropriate, any practice, process, or activity regarding the servicing, repair, disposal, or installation of equipment…that involved: (A) a regulated substance; (B) a substitute for a regulated substance; (C) the reclaiming of a regulated substance used as a refrigerant; or (D) the reclaiming of a substitute for a regulated substance used as a refrigerant.’ Such regulations, if finalized, could increase the level of reclamation in the future.” (Page 151).

ASA will continue monitoring and responding to these regulatory developments.

ASA Signs Letter Urging CT DMV Commissioner to Reconsider Interpretations of New Law

Today, ASA joined with five other organizations in sending a letter to Connecticut Department of Motor Vehicle Commissioner Tony Guerrera. The letter respectfully urges Commissioner Guerrera to reconsider his interpretation of a new law passed by the state legislature - and in effect starting October 1, 2023 - intended to better inform drivers on open recalls on their vehicles.

"...with regard to excluding new car dealers from compliance with Public Act No. 23-40 New Section 24," the letter states, "The Connecticut General Assembly just passed New Section 24 because consumers haven’t been receiving lawfully required timely notice of recalls. Excluding new car dealers would be more than anti-competitive—it would undermine the law’s objective."

The letter also requests Commissioner Guerrera revise his position his position on qualifying notifications by allowing "providing consumers with the National Highway Traffic Safety Administration (NHTSA)’s website link to get a free download of the SaferCar App to satisfy providing recall information in writing."

ASA and its partners originally sent a letter to Commissioner Guerrera on September 15 to determine if automotive dealerships would be subject to the same recall notification requirements to which vehicle repair and service providers are subject under the new law. It also sought clarity on whether certain forms of digital communications qualified as "written notification."

The letter's signatories received the Commissioner's response on October 2. He noted in that letter that, "The Department of Motor Vehicles (DMV) does not interpret applicable provisions to include a new car dealer." He also stated that "providing an online link to where consumer can find [open recall] information online...would not be sufficient."
